1. Introduction

This Promotion of Access to Information Act (PAIA) Manual has been prepared in accordance with Section 51 of the Promotion of Access to Information Act, 2 of 2000, as amended by the Protection of Personal Information Act, 4 of 2013 (POPIA).

The purpose of this Manual is to provide information on the records held by Aquila Collection and the procedures to be followed in requesting access to such records.

4. Guide to using PAIA

The South African Human Rights Commission (SAHRC) has compiled a guide on how to use PAIA, which is available from the SAHRC website.

5. Records available without a formal PAIA request

The following records are available without the need to submit a formal PAIA request:

  • Information available on Aquila Collection websites
  • Public marketing material
  • Published media releases

6. Records available upon request

The following categories of records are held by Aquila Collection and may be made available upon request, subject to applicable legislation:

6.2 Financial records

  • Accounting records
  • Tax records
  • Invoices and payment records

6.3 Human resources records

7. Records automatically available to the public

Where records are made available to the public in terms of legislation, those records will be provided without the need for a PAIA request.

8. Request procedure

A requester must complete the prescribed PAIA request form and submit it to the Information Officer using the contact details provided above.

Requests must provide sufficient detail to enable Aquila Collection to identify the requested record.

9. Fees

Aquila Collection reserves the right to charge a reasonable fee for access to records, as permitted under PAIA.

10. Grounds for refusal of access

Access to records may be refused on grounds set out in PAIA, including but not limited to:

  • Protection of personal information
  • Commercial confidentiality
  • Safety and security concerns

11. Protection of personal information

Aquila Collection processes personal information in accordance with POPIA. Personal information will only be disclosed where legally required or permitted.

12. Availability of this manual

This PAIA Manual is available on all Aquila Collection websites and may be updated from time to time.

This PAIA Manual applies across all Aquila Collection entities and properties unless otherwise stated.
